1. Who we are

PokerInsights is operated by Perceptium GmbH, Rooseweidstrasse 8, 8832 Wollerau, Switzerland (CHE-408.563.585), referred to below as "we" or "us". By creating an account or using PokerInsights you agree to these terms.

2. What PokerInsights is

PokerInsights is a study and analysis tool. It reads poker hand history files that you upload, analyzes the decisions in them, shows statistics about your own play and offers practice exercises. It works only after your sessions, on data your poker site itself exports to you.

PokerInsights is educational software. It does not guarantee poker results of any kind. Analysis, verdicts and training content are informational; decisions at the tables, and their outcomes, are yours.

3. What PokerInsights is not

PokerInsights is not a gambling service: you cannot play poker, wager or win money in it. It provides no real-time assistance, no overlays and no automation of play, and it is designed to be used only between sessions. You are responsible for complying with the terms of the poker sites you play on.

4. Your account

You must be at least 18 years old.
Provide a valid e-mail address and keep your password safe; you are responsible for activity on your account.
One account per person. Accounts are personal and may not be shared or resold.

5. Beta period

While PokerInsights is in closed beta, access is granted personally, no payments are collected, and the service is provided as-is for testing purposes. Features may change. Beta accounts and their data are kept when the service launches commercially.

6. Subscriptions and payment

Paid plans, their features and prices are shown at checkout. Payments are processed by Stripe; we never see or store your card details.
Subscriptions renew automatically (monthly or yearly) until cancelled. You can cancel any time in the app; your plan then simply runs until the end of the period you paid for.
First purchases are covered by a 14-day money-back guarantee, described in the Refund policy.

7. Your data

Your hand histories, results and settings belong to you. We use them solely to provide the service to you, as described in the Privacy policy. You can export everything you own as a single file at any time, and deleting your account permanently removes your database.

8. Acceptable use

Do not upload data that is not yours to use, and do not use the service to violate any poker site's terms or any law.
Do not probe, overload, reverse engineer or resell the service, and do not attempt to access other users' data.

We may suspend or terminate accounts that break these rules. Where reasonable, we will warn you first.

9. Availability and changes

We aim for the service to be reliable, but it is provided without a guarantee of uninterrupted availability. We may improve or change features over time. If a change materially reduces what a paid plan offers, we will tell you in advance.

10. Liability

To the extent permitted by law, our total liability arising from the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect damages, lost profits or poker losses. Nothing in these terms excludes liability that cannot be excluded under Swiss law.

11. Governing law

These terms are governed by Swiss law. Place of jurisdiction is the seat of Perceptium GmbH (Canton of Schwyz, Switzerland), subject to any mandatory consumer protections of your country of residence.

12. Changes to these terms

We may update these terms as the product evolves. Material changes are announced by e-mail or in the app before they take effect. Continuing to use the service after that means you accept the updated terms.
